OVERVIEW
Greenbelt Outdoors LLC ("we", "us", "our") operates greenbeltoutdoors.com and the self-service Adventure Crate at Jessica Hollis Park in Austin, Texas. By using this website or renting equipment from us, you agree to these Terms of Service.
We rent paddleboards, kayaks and packrafts. We do not sell equipment through this website. Reservations and payments are handled by Peek Pro, our third-party booking provider, under their own terms.
If you do not agree to these terms, do not use the site or rent from us.
SECTION 1 - WHO MAY RENT
By booking, you confirm that you are at least the age of majority in your state of residence, or that you have the consent of a parent or guardian. An adult must book for, and remain responsible for, any minor using our equipment.
Every person in your party must be able to swim and must be comfortable in open water. You are responsible for assessing your own ability and that of anyone in your party before you get on the water.
SECTION 2 - RESERVATIONS AND PAYMENT
Reservations are made online through Peek Pro. Rates, available rental windows, deposits, changes, cancellations and refunds are governed by the terms and policies presented to you in that booking flow at the time you book. Nothing on this website overrides what you agree to there.
Prices are subject to change without notice. A change in price does not affect a booking you have already paid for.
SECTION 3 - LIABILITY WAIVER AND IDENTIFICATION
Every renter must sign our digital liability waiver and upload a government identification document before access codes are issued. The waiver is a separate agreement. These Terms of Service do not replace it, limit it, or change it, and where the two documents address the same subject, the waiver controls.
We will not release equipment to anyone who has not completed the waiver.
SECTION 4 - ACCESS CODES
After your waiver is signed, we send PIN codes for the container and for the specific item assigned to you. Those codes are personal to your booking.
You agree not to share your codes with anyone outside your party, not to use codes issued for a different booking, and not to take, move or exchange equipment other than the item assigned to you. All locks must remain with the gear they were issued on: moving a lock between items breaks the link between a customer and their equipment and prevents us from issuing correct codes.
SECTION 5 - YOUR RENTAL WINDOW
Your rental period begins and ends at the times shown on your booking. The Adventure Crate sits inside a park and is reachable only during park hours.
Equipment must be returned before your booking window ends, in the same condition, to the same rack, with the smart lock and chain secured to the D-ring and the container door locked. You must text us a photo of the gear locked back on its rack and a photo of the locked container door.
A fee of $50 applies where equipment is not returned as described above.
SECTION 6 - CONDITION AND CARE OF EQUIPMENT
Inspect your equipment before you launch. Do not use any item that appears damaged; contact us instead.
You are responsible for the equipment from the moment you unlock it until it is returned and locked. You agree to pay the cost of repair or replacement for loss or for damage beyond normal wear, and for any recovery costs we incur if equipment is abandoned or left unsecured.
SECTION 7 - SAFETY AND ASSUMPTION OF RISK
Paddling is a physical activity conducted on open water and carries inherent risks, including drowning, injury, hazardous water conditions, weather, wildlife, collision and equipment failure. You accept those risks. Use the provided life vest. Do not use our equipment while under the influence of alcohol or drugs.
We do not supervise your activity, and no employee is present at the crate. You are responsible for your own decisions on the water, including whether conditions are safe to launch and when to come off the water.
SECTION 8 - PARK ACCESS AND RULES
Jessica Hollis Park is operated by the Lower Colorado River Authority. Your use of the park is subject to LCRA rules, park hours and any closure the LCRA imposes. We do not control park access, park conditions or park closures, and we are not responsible for a closure preventing your use of a booking.
SECTION 9 - ACCURACY OF INFORMATION ON THIS SITE
The material on this site is provided for general information. We are not responsible if information here is not accurate, complete or current, and we have no obligation to update it except as required by law. We may correct errors in descriptions, pricing or availability at any time.
SECTION 10 - THIRD-PARTY SERVICES AND LINKS
This site uses third-party services, including Peek Pro for booking and payment and Google Maps for location. Links and embedded content may take you to third-party sites we do not control. We are not responsible for their content, accuracy, policies or practices. Review their terms before you use them.
SECTION 11 - PERSONAL INFORMATION
Information you submit through this site and through the booking and waiver flows is handled under our privacy policy, at greenbeltoutdoors.com/privacy-policy/.
SECTION 12 - PROHIBITED USES
In addition to the other prohibitions in these terms, you may not use the site or its content: for any unlawful purpose; to solicit others to perform or participate in any unlawful acts; to violate any federal, state or local law, regulation or ordinance; to infringe our intellectual property rights or those of others; to harass, abuse, insult, harm, defame, slander, disparage, intimidate or discriminate; to submit false or misleading information; to upload or transmit viruses or any other malicious code; to collect or track the personal information of others; to spam, phish, pharm, pretext, spider, crawl or scrape; for any obscene or immoral purpose; or to interfere with or circumvent the security features of the site. We may terminate your use of the site for any of these.
SECTION 13 - DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY
We do not guarantee that your use of this site will be uninterrupted, timely, secure or error-free. The site and the rental service are provided "as is" and "as available", without representations, warranties or conditions of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, durability, title and non-infringement, except as expressly stated by us.
To the maximum extent permitted by law, Greenbelt Outdoors LLC and its officers, employees, agents, contractors, suppliers and service providers are not liable for any injury, loss, claim, or direct, indirect, incidental, punitive, special or consequential damages of any kind arising from your use of this site, the rental service or any equipment, whether based in contract, tort (including negligence), strict liability or otherwise, even if advised of their possibility. Some states do not allow the exclusion or limitation of liability for consequential or incidental damages; in those states our liability is limited to the maximum extent permitted by law.
Nothing in this section limits the separate liability waiver you sign before renting.
SECTION 14 - INDEMNIFICATION
You agree to indemnify, defend and hold harmless Greenbelt Outdoors LLC and its officers, directors, agents, contractors, suppliers and employees from any claim or demand, including reasonable attorneys' fees, made by any third party arising out of your breach of these Terms of Service, your use of our equipment, or your violation of any law or the rights of a third party.
SECTION 15 - SEVERABILITY
If any provision of these Terms of Service is determined to be unlawful, void or unenforceable, that provision is severable and the remaining provisions stay in force.
SECTION 16 - TERMINATION
Obligations and liabilities incurred before termination survive termination. These terms are effective until terminated by you or by us. We may refuse service, cancel a booking or deny access to our equipment at our discretion, including where we believe these terms or the waiver have been breached.
SECTION 17 - ENTIRE AGREEMENT
These Terms of Service, together with the liability waiver and the terms presented in the booking flow, are the entire agreement between you and us regarding your use of this site and our rental service. Our failure to enforce any provision is not a waiver of it. Ambiguities are not construed against the drafting party.
SECTION 18 - GOVERNING LAW
These Terms of Service are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict-of-laws rules.
SECTION 19 - CHANGES TO THESE TERMS
You can review the current version of these terms on this page at any time. We may update or replace any part of them by posting changes to this website. Your continued use of the site or our service after changes are posted constitutes acceptance of those changes.
